By accessing our site or confirming a reservation, you acknowledge that you have read, understood, and agree to be bound by the terms detailed below. If you do not agree with any part of these terms, please refrain from using our services.


Introduction and Agreement to Terms

1.1 Acceptance of Terms: By visiting our website, using our services, submitting an inquiry, or booking an event, you agree to abide by these Terms and Conditions, our Privacy Policy, and all applicable federal, state, and local laws and regulations. This includes acceptance of any future modifications or updates to these terms.

1.2 Enforceability: If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.

1.3 Age Requirement: You must be at least 18 years old and have the legal capacity to enter into binding contracts in order to use our services or book an event. By doing so, you affirm that you meet this age requirement.

1.4 Entire Agreement: These Terms and Conditions constitute the entire agreement between you and Sterling Photo Booth with respect to the use of the website and services, superseding any prior agreements, communications, or understandings, whether oral or written.

1.5 Electronic Communication: By using our website or submitting any form or inquiry, you consent to receive communications from us electronically, including emails, text messages, and notices posted on the website.

1.6 Right to Refuse Service: Sterling Photo Booth reserves the right to refuse service to anyone for any reason at any time, including but not limited to concerns of safety, venue incompatibility, or breach of these Terms.


Scope of Services


2.1 Service Description: Sterling Photo Booth offers professional photo booth rentals for a variety of events including weddings, corporate functions, birthdays, anniversaries, trade shows, and other private or public events. Our services typically include photo booth delivery, setup and breakdown, onsite operation, digital and physical photo outputs, use of themed props, custom templates, backdrops, and professional attendant(s), as outlined in the individual client agreement.

2.2 Customization and Add-ons: Clients may choose from a selection of customizable options, such as branded templates, upgraded backdrop selections, premium props, animated GIFs, video messaging, or social media integration. These enhancements may incur additional fees and must be confirmed in writing prior to the event.

2.3 Service Availability and Booking Confirmation: All services are provided subject to availability. Sterling Photo Booth does not guarantee availability until a written agreement is signed and the required deposit has been received. Submission of an inquiry or quote request does not constitute a confirmed reservation.

2.4 Travel and Location Limitations: Service availability may be limited by location, accessibility, and distance from our primary service area. Additional travel fees may apply for venues located outside of designated service zones.

2.5 Event Duration and Overtime: Standard service includes a fixed duration of operation, as outlined in the booking agreement. Requests for additional time must be made in advance and are subject to availability and additional charges. Unscheduled overtime, if accommodated, will be billed at the prevailing hourly rate.

2.6 Subcontracted Services: In some cases, Sterling Photo Booth may partner with or subcontract to trusted vendors to fulfill certain aspects of service delivery. All subcontracted work is held to our same quality standards, and clients will be informed in advance if applicable.


Bookings and Payments


3.1 Booking Confirmation: A booking is only considered confirmed once a signed contract and a non-refundable deposit have been received by Sterling Photo Booth. Verbal confirmations, emails, or chat communications do not constitute a formal booking. Until these two components are received, Sterling Photo Booth reserves the right to offer the date and time to other clients.

3.2 Deposit: A non-refundable deposit is required to secure the date and time for your event. The amount of the deposit will be outlined in your booking agreement. Deposits are applied toward the final balance due and are non-transferable unless explicitly approved by management in writing.

3.3 Final Payment: The remaining balance must be paid in full no later than seven (7) calendar days prior to the event date. Failure to make payment on time may result in cancellation of the booking without refund of the deposit.

3.4 Payment Methods: We accept payments via credit card, debit card, bank transfer, Zelle, or through our secure online payment portal. Additional payment methods may be available and are listed in your invoice. All transactions must be completed in U.S. dollars. Clients are responsible for any associated transaction or processing fees.

3.5 Late Payments and Default: If final payment is not received by the due date, Sterling Photo Booth reserves the right to apply late payment penalties, cancel the reservation, or withhold services until payment is made. If services are rendered but payment is defaulted, legal action or collection proceedings may be initiated to recover the balance due.

3.6 Returned Payments: Any returned payments or failed transactions may result in additional administrative fees. Services will not proceed until all outstanding balances and fees are paid in full.


Cancellations and Refund Policy


4.1 Client-Initiated Cancellations: All cancellations must be submitted in writing via email or certified mail. Verbal cancellations are not considered valid. Deposits are non-refundable under all circumstances. Cancellations received less than fourteen (14) days prior to the event date may result in forfeiture of the entire balance.

4.2 Rescheduling: Clients may request to reschedule their event at least fourteen (14) days prior to the event date, subject to availability and written approval. Rescheduled events must be held within six (6) months of the original date, and rescheduling may incur additional fees depending on availability and pricing at the time of the new date.

4.3 Company-Initiated Cancellations: In the rare case that Sterling Photo Booth must cancel a service due to unforeseen circumstances such as equipment failure, staff emergency, or safety concerns, clients will be notified as soon as possible and receive a full refund of all monies paid. Sterling Photo Booth will not be liable for any additional damages or consequential losses.

4.4 Force Majeure: Neither party shall be held liable for failure to perform obligations under this agreement if such failure is due to acts beyond their reasonable control. These include, but are not limited to, natural disasters, acts of God, war, terrorism, pandemics, government restrictions, labor disputes, or power outages. In such events, the affected party must notify the other party promptly. A good-faith effort will be made to reschedule the service.

4.5 Partial Services Rendered: If services are partially rendered and then interrupted due to conditions outside of Sterling Photo Booth’s control (e.g., venue issues, client delays), no refund or discount shall be given for the time lost. Clients are encouraged to ensure venue preparedness and timeliness to receive full service value.


Venue Requirements and Client Responsibilities


5.1 Space & Access: It is the client’s responsibility to ensure the venue provides adequate space, accessibility, and resources for proper setup and operation of the photo booth. This includes but is not limited to: a flat and stable surface, minimum space requirements (typically 8’x8’), one standard electrical outlet within 10 feet of the booth, sufficient lighting, and climate control (indoor temperatures between 65–80°F for optimal equipment function).

5.2 Venue Coordination: The client is responsible for coordinating with the venue to allow early access for setup and teardown. If the venue imposes restrictions or limitations (e.g., loading dock access, union labor requirements), the client must communicate these to Sterling Photo Booth in advance. Any fees or logistical arrangements imposed by the venue are the responsibility of the client.

5.3 Delays and Reduced Service Time: Delays caused by unprepared venues, inaccessible areas, or miscommunication with venue staff may result in a reduction of active booth time. No compensation, refund, or time extension will be granted in these situations unless explicitly agreed upon in writing.

5.4 Supervision of Minors: Children under the age of 12 must be accompanied by a responsible adult when using the booth. Sterling Photo Booth is not liable for injuries, accidents, or damage caused by unsupervised minors.

5.5 Liability for Damage: The client assumes full financial responsibility for any loss or damage to Sterling Photo Booth’s equipment caused by guests, venue staff, or external vendors due to negligence, improper handling, or misuse. This includes liquid spills, intentional tampering, physical obstruction, or theft. Damage fees will be billed post-event and are due upon receipt.


Service Limitations


6.1 Technical Issues and Downtime: Sterling Photo Booth takes all reasonable measures to ensure the booth and associated equipment operate smoothly. However, the company shall not be held liable for interruptions or downtime caused by venue-related electrical issues, internet disruptions, software malfunctions, or third-party service failures.

6.2 Photo Output and Environmental Factors: Photo quality and booth performance are influenced by venue lighting, layout, and guest behavior. While we strive for consistency and excellence, we do not guarantee color accuracy, image resolution, or print quality in uncontrolled environments.

6.3 Guest Conduct and Safety: Sterling Photo Booth reserves the right to pause or terminate services without refund if guest behavior compromises the safety of staff or the integrity of the equipment. This includes excessive intoxication, aggressive behavior, physical threats, or tampering with the booth system.

6.4 Service Scope Limits: Sterling Photo Booth’s obligation is limited to the services and duration specified in the signed agreement. Additional requests during the event are subject to availability and may not be guaranteed.


Intellectual Property and Usage Rights


7.1 Ownership of Media: All photographs, GIFs, videos, designs, and content created by Sterling Photo Booth during an event are the exclusive intellectual property of Sterling Photo Booth, protected under applicable copyright laws.

7.2 License for Client Use: Clients are granted a limited, non-exclusive, royalty-free license to download, share, and display their event media for personal, non-commercial use. Commercial or promotional use of images without prior written consent is strictly prohibited.

7.3 Third-Party Access: Clients may not resell, alter, sublicense, or distribute event content to third parties, including vendors, without written permission.

7.4 Company Promotional Use: Unless explicitly stated otherwise in writing by the client before the event, Sterling Photo Booth reserves the right to use event images and video clips for promotional purposes, including social media, online galleries, print advertising, and website portfolio.

7.5 Right to Remove Content: Sterling Photo Booth reserves the right to remove or withhold any image deemed inappropriate, offensive, or damaging to the company’s reputation.


Privacy Policy and Data Handling


8.1 Data Collection: Sterling Photo Booth collects personal data, including but not limited to names, email addresses, phone numbers, event dates and types, venue details, and service preferences. This information is obtained through web forms, phone calls, email communications, online bookings, and in-person interactions.

8.2 Purpose and Use of Data: Collected data is used solely for the purpose of fulfilling service requests, processing payments, managing bookings, internal recordkeeping, and improving client experience. Data may also be used for follow-up communication, client support, feedback requests, or promotional updates unless the client opts out.

8.3 Data Storage and Retention: Personal information is stored securely using encrypted cloud-based systems. Data is retained only as long as necessary to fulfill service obligations, meet legal or tax requirements, or as permitted for marketing purposes. Clients may request deletion of their data in accordance with applicable privacy laws.

8.4 Third-Party Data Sharing: Sterling Photo Booth does not sell, trade, or rent client data to unauthorized third parties. Data may be shared with trusted service providers (e.g., payment processors, CRM platforms, or subcontractors) solely for the purpose of delivering our services. All third-party vendors are contractually bound to maintain data confidentiality and security.

8.5 Security Measures: We implement industry-standard security protocols to protect personal data, including SSL encryption, password-protected databases, and restricted access controls. While we strive to use commercially acceptable means to protect your information, no method of transmission or storage is 100% secure, and we cannot guarantee absolute data security.

8.6 Client Rights: Clients may request access to, correction of, or deletion of their personal data by contacting us directly. Where applicable, clients may also file complaints with relevant data protection authorities.

8.7 Privacy Policy Updates: Our privacy practices may evolve over time. Any updates to our Privacy Policy will be posted on our website with a revised effective date. Continued use of our services following changes constitutes your acceptance of the updated terms.


Text, Email, and Digital Communications


9.1 Consent to Receive Communications: By submitting contact information through any form, booking system, or communication channel, you consent to receive email messages, phone calls, and SMS/MMS messages from Sterling Photo Booth regarding your inquiry, event details, customer service, updates, and promotional offers.

9.2 Opt-Out Procedures: You may opt out of promotional emails by clicking the “unsubscribe” link provided in the message. For SMS marketing, you may opt out by replying STOP. Please note that opting out of marketing messages will not prevent necessary transactional communications related to your booking.

9.3 Regulatory Compliance: Sterling Photo Booth adheres to all applicable communication laws, including the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA). All marketing communications include opt-out instructions and are only sent to users who have given consent.

9.4 Carrier and Message Fees: Standard message and data rates may apply depending on your mobile carrier plan. Sterling Photo Booth is not responsible for any charges incurred through receiving communications.

9.5 A2P Compliance: Sterling Photo Booth uses registered messaging platforms that comply with Application-to-Person (A2P) standards to maintain deliverability and compliance with carrier requirements.

9.6 Communication Frequency: While we strive to limit the number of messages sent, frequency may vary depending on the nature of your engagement and the duration of your event planning.

9.7 Client Responsibility: It is the client’s responsibility to provide accurate and up-to-date contact information. Sterling Photo Booth is not liable for missed communications due to incorrect or outdated contact details.


Chat Support Disclaimer


10.1 Purpose of Chat Support
Sterling Photo Booth provides a website-based chat feature to assist users with general inquiries, event-related questions, and support regarding services offered. The chat tool is designed for informational and convenience purposes only. It serves as a preliminary communication channel and does not replace formal communication, such as signed contracts, invoices, or official documentation. Use of the chat feature does not constitute a legally binding agreement, quote, service guarantee, or official booking confirmation.

10.2 No Guarantee of Accuracy or Completeness
While we strive to provide accurate and helpful information via chat, Sterling Photo Booth makes no representations or warranties regarding the accuracy, completeness, or timeliness of responses provided through the chat feature. Any information provided is subject to change without notice and should not be relied upon for final decision-making or planning without written confirmation from an authorized representative of Sterling Photo Booth.

10.3 No Contract Formation
Conversations held through the chat system, including pricing inquiries, service availability, or scheduling discussions, are not legally binding and do not form the basis of a service contract. A service is only considered booked once a formal agreement is signed and a deposit is received in accordance with our booking policy.

10.4 Confidentiality and Data Sensitivity
Users are strictly advised not to submit sensitive personal information through the chat feature. This includes, but is not limited to, credit card details, social security numbers, passwords, banking information, health data, or any confidential corporate data. 10.6 Third-Party Chat Providers

For any matter involving contracts, bookings, payments, cancellations, refund requests, disputes, or legal notices, communication must be made through official written means, such as email or postal mail, and addressed to Sterling Photo Booth's business contact as listed on our website.


Limitation of Liability


11.1 Exclusion of Certain Damages: To the maximum extent permitted by law, Sterling Photo Booth shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising out of or related to the use of our services. This includes, but is not limited to, lost profits, loss of business opportunity, loss of data, reputational harm, or emotional distress—even if we have been advised of the possibility of such damages.

11.2 Service Interruptions or Failures: Sterling Photo Booth is not responsible for any damages or losses resulting from system failures, equipment malfunction, or vendor errors that are outside of our direct control.

11.3 Client Responsibilities: Clients are responsible for ensuring venue readiness, timely communication, accurate event information, and guest behavior. We are not liable for disruptions caused by third-party vendors, venue staff, or guests.

11.4 Maximum Liability: In any event, Sterling Photo Booth’s total cumulative liability to the client for any claim, loss, or damage shall not exceed the total amount paid by the client to Sterling Photo Booth for the specific event or service in question. This limitation applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.

11.5 No Warranty: All services are provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.


Governing Law and Dispute Resolution


12.1 Jurisdiction and Legal Venue: These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the State of Nevada. Any legal actions, proceedings, or disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts located in Clark County, Nevada.

12.2 Dispute Resolution Process: In the event of a dispute, both parties agree to first attempt to resolve the matter through informal negotiation. If unresolved, the dispute shall be submitted to mediation. If mediation is unsuccessful, the parties agree to binding arbitration conducted in Clark County, Nevada, pursuant to the rules of the American Arbitration Association. Each party shall bear its own legal fees unless otherwise determined by the arbitrator.

12.3 Equitable Relief: Notwithstanding the foregoing, Sterling Photo Booth retains the right to seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened misuse of its intellectual property or confidential information.

12.4 Time Limitation for Claims: Any claims against Sterling Photo Booth must be brought within one (1) year of the cause of action arising, or such claims shall be deemed waived and permanently barred.


Amendments


13.1 Right to Modify: Sterling Photo Booth reserves the right to update, change, or modify these Terms and Conditions at any time without prior notice. Modifications will take effect immediately upon posting to our website.

13.2 Notice of Changes: While we may choose to notify clients via email or banner notification, it is the responsibility of the client to review the most current version of the Terms on our website.

13.3 Acceptance of Amendments: Continued use of our services following any changes to these Terms constitutes acceptance of those changes. If you do not agree to the amended terms, you must discontinue use of our services.
